Time is running short as the U.S. Census Bureau is set to announce reapportionment numbers based on the 2020 Census outcome, which will reveal whether or not Alabama will keep or lose one of its congressional seats.
Last week, U.S. Rep. Mo Brooks (R-Huntsville) was deposed in the federal suit State of Alabama & Mo Brooks vs. U.S. Census Bureau & U.S. Department of Commerce. The suit was filed in 2018 by Alabama Attorney General Steve Marshall and Brooks and calls into question methodologies used by the U.S. Census Bureau that include illegal aliens in the count for the sake of apportionment of congressional seats and Electoral College votes.
During an interview with Mobile radio’s FM Talk 106.5, Brooks said he hoped for a decision soon, as the U.S. Census Bureau pronouncement will come either in December or January.
“I hope that we will have a court order sometime this fall,” Brooks said. “We need a court order before the pronouncement is made by the Census Bureau, sometime in December, January on the reapportionment issues. And reapportionment is how many congressmen and how many Electoral College votes for president each state has. And the indicators are high probability that if illegal aliens are counted around the country for the purposes of distributing political power that Alabama is going to lose a congressional seat and lose an Electoral College vote, thereby diminishing our influence in the governance of our country.”
He continued, “So, I’m fighting that along with Attorney General Steve Marshall, and hopefully, we’ll have a successful verdict from a federal judge in Birmingham. Time will tell. I think we’re in pretty good shape on the 14th Amendment, equal protection, one man-one vote principles. Each person’s vote should count the same, and citizens votes don’t count the same if you allow sanctuary states to get a disproportionate number of Electoral College votes and congressional seats for their support of illegal conduct.”
