During this week’s broadcast of APTV’s “Capitol Journal,” Alabama Attorney General Steve Marshall reiterated his agency’s opposition to former State House Speaker Mike Hubbard’s early release from prison.
Hubbard, who is 12 months into a 28-month sentence, sought an early release from prison after issuing a public apology.
The AG’s office followed up by calling into question the authenticity of Hubbard’s apology, with Marshall adding that Hubbard having success would be “incredibly unique” and “highly unusual.”
“Ultimately, that’s Judge Walker’s decision in Lee County in whether or not he sees a need to be able to do that,” he said. “Both sides have submitted their arguments. We obviously have submitted a very detailed explanation to the court about why we felt like what was submitted on Speaker Hubbard’s behalf was not completely candid and truthful. And we believe we have a very compelling reason why the courts should deny it.”
“Let’s make this clear: The remedy Speaker Hubbard is seeking would be incredibly unique,” Marshall continued. “When somebody is serving a split sentence, the expectation of the court is that somebody will serve that full time. And although the court still has jurisdiction, which gives them the ability to make argument here — it would be highly unusual, in fact, it would be the first time in my career as a prosecutor for almost 20 years that I would see a judge grant relief early for an individual.”
“We simply say that Judge Walker heard the evidence at the time of trial. Consider the evidence in sentencing and ask him to keep that order in place,” he added.
