As we reported earlier today, Jeffrey Lynn Borden was set to be executed at 6:00 this evening for committing a gruesome double murder of his wife and father-in-law on Christmas Eve, 1993 as the family celebrated the holiday following the couple’s estrangement.

Borden’s execution was stayed last month by the 11th Circuit Court. In response, the Alabama Attorney General Steve Marshall filed an appeal with the U.S. Supreme Court challenging the circuit court’s injunction, and in a 5-3 decision, the Supreme Court overturned the stay, clearing the way for the execution tonight.

Late this afternoon, however, Borden was granted another stay by a lower federal court, despite the Supreme Court’s ruling.

In response, Yellowhammer received a statement from Alabama Attorney General Steve Marshall that said:

“Despite the fact that the U.S. Supreme Court has already agreed to proceed with Mr. Borden’s execution, the lower federal courts continue to place roadblocks in the victims’ family’s pursuit of justice.  Because there is insufficient time to lift the stay before midnight, we will seek a new execution date as soon as possible.”
