Trump classified documents case dismissed – ‘A major victory for President Trump over Biden’s weaponized government’

Alabama political leaders are praising the decision of a federal judge in Florida to dismiss the classified documents case against former President Donald Trump.

Federal Judge Aileen Cannon dismissed the case because she said the appointment of special counsel Jack Smith as prosecutor for the case was unconstitutional.

Trump was accused of illegally keeping classified documents at his home in Mar-a-Lago Florida after leaving the White House. He was also being accused of obstructing federal officials who wanted them returned.

Judge Cannon said Garland violated the Constitution’s appointments clause because the special counsel was not appointed by the president and confirmed by the U.S. Senate.

Alabama Attorney General Steve Marshall said this was a win for the rule of law.

“It is encouraging to see the failure of yet another attempt at lawfare/election interference against Pres. Trump,” Marshall said. “As we noted in numerous briefs, the documents case against Pres. Trump was never about the rule of law, only confusing voters. The Constitution wins again.”

U.S. Rep. Barry Moore (R-Enterprise), who sits on the House Judiciary Committee, lauded the judge’s decision.

U.S. Sen. Tommy Tuberville (R-Auburn) also said it was good news.

“Good,” Tuberville said. “If Americans can’t trust our justice system then we are no better than Venezuela.”

The special counsel’s office is expected to appeal the decision to the 11th Circuit Court of Appeals.
