The U.S. Supreme Court has decided to keep Title 42 in place at the border. This decision blocks the Biden administration from ending the border policy put in place as an emergency measure during the COVID-19 pandemic.
The 5-4 vote had Justice Neil Gorsuch siding with the more liberal members of the court in the dissent.
“For my part, I do not discount the states’ concerns,” Gorsuch said. “But the current border crisis is not a COVID crisis. And courts should not be in the business of perpetuating administrative edicts designed for one emergency only because elected officials have failed to address a different emergency.
“We are a court of law, not policymakers of last resort.”
U.S. Rep. Barry Moore (R-Enterprise) praised the decision, but cautioned that more needs to be done to truly secure the border.
“While this news is positive, our border will remain in crisis until Biden commits to ending lawlessness at our border and beyond,” he said.

U.S. Rep. Gary Palmer (R-Hoover) also agreed with the court’s decision and blasted Biden for the continuing crisis.
“The Biden Administration has no plan to stop the unfolding crisis at the southern border and is putting Americans at risk with their decision making,” Palmer said.

Incoming U.S. Sen. Katie Britt weighed in as well saying, “This is good news.”

This ruling keeps Title 42 in place for now, but the court has agreed to hear the appeal of a lower court ruling from several states.
