Alabama’s Republican congressional delegation is applauding the effort of Alabama Attorney General Steve Marshall who is fighting back against Biden’s recent changes to the Title IX rule.
Marshall filed a federal lawsuit on Monday challenging the Biden administration proposed change the meaning of “sex” to “gender identity” in Title IX.
Alabama Attorney General Steve Marshall filed suit on behalf of Alabama, joined by Florida, Georgia, and South Carolina.
Marshall and State Education Superintendent Eric Mackey also released a joint statement Tuesday advising schools not to implement any of the provisions contained in the new rule because it could violate existing state law.
“Yesterday, the State of Alabama filed a lawsuit challenging the U.S. Department of Education’s recently announced rule on Title IX,” the statement reads. “Title IX, as passed by Congress in 1972, prohibits sex-based discrimination in any education program or activity that receives federal funding. The new rule seeks to expand the meaning of “sex” to include sexual orientation and gender identity. Compliance with the rule may run afoul of relevant state law. Please be advised that no public school district in the State of Alabama should take any step to implement the new Title IX rule at this time. Further guidance will be provided as the litigation proceeds and before the rule takes effect on August 1, 2024.”

U.S. Rep. Gary Palmer (R-Hoover) called the change “unacceptable.”
“I’m proud of Alabama for pushing back on Biden’s disastrous Title IX revisions,” Palmer said. “Instead of protecting women, the current administration is trying to use Title IX to further a radical political agenda. This is unacceptable, and we will not stand for it.”

U.S. Rep. Jerry Carl (R-Mobile) said he’s “proud” of his state for fighting against the attack on women’s sports.
“Congress wrote Title IX to protect women. Yet Biden chose to rewrite Title IX to protect men who ‘identify’ as women,” Carl said. “There is no room for men in women’s sports. I am proud to represent a state where we will always stand up to protect our women and girls in sports.”

U.S. Sen. Tommy Tuberville (R-Auburn) argued that this just proves Biden has “RUINED our education system.”
