Daniels’ bill would add rape and incest exception to abortion restriction

House Minority Leader Anthony Daniels has filed a bill amending the state’s anti-abortion law that would include exceptions in the cases of rape and incest.

Alabama’s Human Life Protection Act, which went into effect after Roe v. Wade was overturned in June 2022, is among the most restrictive abortion law in the nation. It imposes a near-total ban on abortions with extremely limited exceptions generally having to do with the safety of the mother.

Daniels’ (D-Huntsville) bill would amend the original bill and add exceptions including cases of rape and incest making abortions in these cases legal.

According to the bill, incestuous situations include step-siblings and step-parents, “while the marriage creating the relationship still exists,” as well as aunts, uncles, nephews and nieces.
