Bentley: Gay marriage destroys ‘rights of children’

MONTGOMERY, Ala. — Alabama Gov. Robert Bentley told the United States Supreme Court on Tuesday that same-sex marriage is an assault on the “rights of children to be connected to their biological parents.”

According to the Associated Press, the governor made his case by filing a “friend of the court brief Tuesday.”

U.S. District Judge Callie Granade disagreed with a similar argument made by the state earlier this year, saying that she did not see how same-sex marriages negatively impact children.

“There has been no evidence presented that these marriage laws have any effect on the choices of couples to have or raise children, whether they are same-sex couples or opposite-sex couples,” she wrote in her opinion. “In sum, the laws in question are an irrational way of promoting biological relationships in Alabama.”

Since Judge Granade’s ruling on January 23, Alabama citizens and elected officials have found themselves in the middle of a fight between the federal courts and the state supreme court.

The issue will not be fully decided until U.S. Supreme Court hears oral arguments on the constitutionality of state-level gay marriage bans in April, then ultimately makes a final ruling, likely sometime in the summer.
