U.S. Rep. Barry Moore (R-Enterprise) believes a New York City jury got it right in their not guilty verdict of Daniel Penny.
Penny has been found not guilty of criminally negligent homicide for the death of Jordan Neely by the jury on Monday. In May 2023, Penny, a 25-year-old former Marine, put Neely, a 30-year-old homeless man, in a submission hold after Neely boarded a subway car and started threatening passengers on the train. Penny was also charged with manslaughter, but the jury was unable to agree on a verdict for that charge.
“NOT GUILTY!” Moore said. “Daniel Penny, an American hero and former Marine who was politically targeted by Alvin Bragg for stepping up to protect innocent lives, has been acquitted of all charges and is now a free man! God bless him and his family.”

Manhattan District Attorney Alvin Bragg thanked the jury after the verdict.
“The jury carefully deliberated for four days,” Bragg said in a statement. “They requested readbacks of testimony and asked for video footage to re-watch, as well as written definitions of the law. Their lengthy deliberation – and the totality of the facts and the evidence – underscored why this case was put in front of a jury of Mr. Penny’s peers.”
