Alabama Attorney General Steve Marshall is not happy with a recent court decision because he believes it is an attempt to block a lawful executive order by President Donald Trump.
The San Francisco-based 9th U.S. Circuit Court of Appeals ruled Wednesday that President Trump’s executive order that seeks to end birthright citizenship in the U.S. is “unconstitutional.”
The majority opinion states that “the Executive Order is invalid because it contradicts the plain language of the Fourteenth Amendment’s grant of citizenship to ‘all persons born in the United States and subject to the jurisdiction thereof.’”
The 2-1 ruling by the court upholds a nationwide pause on enforcement of the order.
Marshall argued that this goes directly against a recent decision by the U.S. Supreme Court.
“Just weeks ago, the Supreme Court tired to put an end to the misuse of universal injunctions,” Marshall said. “But as predicted, some lower courts have pressed on with universal relief that obstructs President Trump’s lawful order on birthright citizenship.”
Last month, the court ruled in a 6-3 decision to allow lower courts to issue injunctions only in limited instances, effectively preventing many from putting forward nationwide injunctions against the Trump administration.
“The President’s order will bring great benefits to the State and all American citizens,” Marshall continued. “Our support for President Trump is unwavering, and we will continue to fight to defend his lawful actions.”

The 20-state amicus brief that Attorney General Marshall signed onto in March made the case that President Trump’s executive order is constitutional and reflects the original meaning of the 14th Amendment. The coalition’s brief also cited evidence that up to 250,000 U.S. births per year, “about 7% of all births in the United States, and more than births in any State besides Texas or California—were to illegal immigrants.”
